In these Terms, “Perigon”, “we”, “us”, and “our” refer to the service provider identified above. “Customer”, “you”, and “your” refer to the person or organisation using the website or purchasing our services.
By using the website, you agree to its website-use provisions. Service-related provisions become binding when you accept a quotation or proposal, sign an agreement, confirm an order, or make a payment.
2. Our Services
Perigon provides services that may include:
- Professional 3D scanning
- Interactive 3D virtual tours
- Drone mapping or related visual-capture services
- Processing and preparation of digital material
- Integration or embedding assistance
- Tour hosting, maintenance, and technical support
- Other services described in an individual quotation or proposal
The exact scope, deliverables, timetable, price, and any special requirements will be specified in the applicable quotation, proposal, or written agreement.
3. Quotations and Orders
Unless otherwise stated, quotations are valid for the period shown in the quotation.
An order is confirmed when the Customer accepts our quotation or proposal in writing, signs an agreement, or pays a requested deposit or invoice.
If these Terms conflict with an accepted quotation, proposal, or separately signed agreement, the following order of priority applies:
- The signed agreement
- The accepted quotation or proposal
- These Terms and Conditions
Changes to the agreed scope must be approved in writing and may affect the price and delivery schedule.
4. Customer Responsibilities
The Customer must:
- Provide accurate and complete project information
- Ensure that Perigon can safely and legally access the location
- Obtain permission from the property owner or other authorized person
- Ensure that the location is ready at the agreed scanning time
- Inform us of safety risks, restricted areas, confidentiality requirements, or special operating conditions
- Obtain any permissions needed for people, artwork, trademarks, documents, or other protected material visible at the location
- Review deliverables and provide feedback within the agreed timeframe
The Customer is responsible for removing or securing confidential, sensitive, valuable, or inappropriate items before scanning begins.
Where people must not appear in the final tour, the Customer must arrange for the relevant areas to be vacant or controlled during scanning. We will take reasonable care but cannot guarantee the removal of every person, reflection, confidential item, or identifying detail unless this is agreed as part of the project scope.
5. Appointments, Access and Safety
Scanning appointments must be arranged in advance.
If we cannot perform the service because the location is inaccessible, unsafe, unprepared, or unavailable at the agreed time, we may reschedule the appointment. The Customer may be charged for reasonable costs already incurred where those costs were disclosed in advance or included in the quotation.
Perigon may stop or postpone work where continuing would create a safety, legal, or security risk.
6. Delivery and Revisions
Delivery dates are estimates unless expressly confirmed as fixed in writing.
Delivery may be delayed if:
- The Customer does not provide timely access, information, approvals, or feedback
- Additional work or revisions are requested
- Weather prevents drone or outdoor work
- Technical problems or circumstances outside our reasonable control arise
The Customer must inspect the deliverables promptly and notify us of any material failure to match the agreed specification. We will correct verified defects within a reasonable period.
Creative preferences, requests outside the agreed scope, changes to the property after scanning, or additional capture sessions are not considered defects and may be charged separately.
7. Fees and Payment
Prices, taxes, deposits, payment stages, and due dates will be stated in the applicable quotation or invoice.
Unless otherwise stated:
- Prices exclude VAT and other applicable taxes
- Deposits cover project scheduling and initial work
- Final files, publication, or access may be withheld until outstanding amounts are paid
- Additional work requested by the Customer will be quoted or charged separately
The Customer must notify us promptly if an invoice is disputed and explain the reason for the dispute. Undisputed amounts remain payable by their due date.
8. Cancellation and Rescheduling
The Customer may cancel a project by notifying us in writing.
Unless an accepted quotation provides otherwise, the Customer must pay for:
- Work completed up to the cancellation date
- Reasonable, non-refundable third-party expenses
- Travel or other costs already incurred specifically for the project
Any additional cancellation or rescheduling charge will apply only if it was disclosed in the accepted quotation or agreement.
Perigon may cancel or suspend a project if the Customer does not provide required access, repeatedly delays the project, fails to make payment, or requests work that would be unsafe or unlawful. We will provide reasonable notice where circumstances allow.
9. Hosting and Maintenance
Some virtual tours require ongoing hosting to remain accessible.
Where the accepted quotation includes an initial hosting period, any fee for renewal after that period will be communicated to the Customer before renewal.
Unless automatic renewal has been expressly agreed, hosting will not renew automatically. If the Customer does not renew, we may suspend or remove the hosted tour after providing reasonable notice.
Hosting and maintenance may occasionally be interrupted for updates, security work, technical problems, or circumstances outside our control. We do not guarantee uninterrupted or error-free availability, but we will use reasonable efforts to restore affected services.
10. Intellectual Property
Customer materials
The Customer retains ownership of materials supplied to Perigon.
The Customer grants Perigon a limited licence to use those materials only as necessary to perform the agreed services. The Customer confirms that it has the necessary rights and permissions to provide them.
Perigon materials and technology
Perigon retains ownership of its pre-existing technology, processes, templates, software, methods, know-how, and production tools.
Project deliverables
Ownership and usage rights for the final deliverables will be specified in the accepted quotation or agreement.
If no separate terms are stated, once all applicable fees have been paid, the Customer receives a non-exclusive, non-transferable licence to use the delivered virtual tour and related material for its own business and promotional purposes. Access to hosted elements remains subject to payment of any applicable hosting fees.
The Customer may not resell, sublicense, reverse-engineer, copy, or commercially exploit Perigon’s underlying technology or platform without written permission.
11. Third-Party Platforms
A virtual tour may be embedded or shared through third-party websites and platforms, including social networks, mapping services, booking platforms, or the Customer’s own website.
These platforms are controlled by third parties and may change their technical requirements, availability, policies, or functionality without notice.
Perigon is not responsible for interruptions, restrictions, changes, account suspensions, or technical problems caused by a third-party platform that is outside our reasonable control.
12. Acceptable Use
You must not use the website or any deliverable:
- For unlawful, fraudulent, defamatory, or misleading purposes
- To infringe intellectual-property, privacy, or other legal rights
- To distribute malicious code or interfere with systems or services
- To misrepresent your relationship with Perigon
- To remove copyright, attribution, or ownership notices without permission
- In a way that could damage Perigon, its infrastructure, or other users
We may suspend access where we reasonably believe these conditions have been violated.
13. Website Information
We aim to keep the website accurate and current. However, website content is provided for general information and does not constitute a binding offer unless expressly stated.
Examples, demonstrations, project descriptions, delivery estimates, and general pricing information may not apply to every project. A Customer’s final scope and price are determined by the accepted quotation or agreement.
14. Service Standards and Limitations
Perigon will provide its services with reasonable care and professional skill.
The appearance and performance of a virtual tour may vary depending on the property, lighting, internet connection, device, browser, display, and third-party platform.
Unless expressly included in an accepted quotation, we do not guarantee:
- A particular number of bookings, enquiries, sales, or visitors
- A specific search-engine ranking
- Continuous compatibility with every device or third-party platform
- Exact measurements suitable for engineering, construction, legal, or safety-critical purposes
Any measurements supplied through a virtual tour should be independently verified before being used for construction, procurement, safety, or other decisions requiring certified accuracy.
15. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
To the extent permitted by law, Perigon will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, or loss caused by third-party platforms or circumstances outside our reasonable control.
To the extent permitted by law, Perigon’s total liability relating to a project will not exceed the total amount paid by the Customer for the affected service.
16. Force Majeure
Neither party will be responsible for delay or failure caused by circumstances outside its reasonable control, including extreme weather, natural disasters, government restrictions, internet or utility failures, strikes, epidemics, equipment failure despite reasonable maintenance, or disruption of third-party services.
The affected party must notify the other party as soon as reasonably possible and take reasonable steps to reduce the effects of the disruption.
17. Privacy
Personal data is processed in accordance with our Privacy Policy.
The Customer must not provide unnecessary sensitive personal data through the website or project materials.
18. Consumer Rights
These services are primarily intended for businesses and organisations. However, if you purchase as a consumer, nothing in these Terms limits rights granted to you by mandatory Greek or European Union consumer law.
Where a distance contract for services is subject to a statutory withdrawal period, an eligible consumer may withdraw within 14 days of the contract being concluded.
If the consumer expressly requests that work begin during this period and later withdraws, the consumer may be required to pay for the proportion of services already performed. The right of withdrawal may be lost once the service has been fully performed, provided the consumer expressly agreed to early performance and acknowledged the loss of that right.
Any mandatory information and withdrawal form required for a particular consumer contract will be provided separately where applicable.
19. Complaints
If you have a complaint, please contact us using the details in Section 1 and provide:
- Your name and contact details
- The relevant quotation, invoice, or project reference
- A clear description of the issue
- The outcome you are requesting
We will review the complaint and respond within a reasonable period.
20. Governing Law and Disputes
These Terms and any related agreement are governed by Greek law.
The parties will first attempt to resolve disputes through good-faith communication.
If no resolution is reached, disputes will be submitted to the competent courts of [INSERT CITY], Greece, subject to any mandatory jurisdiction rights available to consumers.
21. Changes to These Terms
We may update these Terms to reflect changes to our services, website, or legal obligations.
Changes will apply from the date the revised Terms are published. Changes will not retroactively alter an already accepted quotation or agreement unless both parties agree in writing.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
